Dashcam footage as evidence

A clip is only worth what the person reviewing it will accept. This site covers two reviewers with very different standards: New York City's DEP, which pays 25% of collected idling penalties but rejects a complaint that misses any item on its evidence list, and the insurer, police officer or court looking at a crash. Here is what each one needs, and what that means for how you set up and use a camera.
For an NYC idling complaint
DEP's evidence list for the Citizens Air Complaint Program, as published on its program page (read October 29, 2026). The dated items took effect on the dates shown.

What that means for the camera: audio recording has to be switched on, the burned-in date and time has to be right, and a forward-facing windshield camera will capture at most one face of a parked truck. A front-and-rear camera helps with the plate, but the sidewalk side and the company name usually mean walking the vehicle with a phone while the dashcam keeps the continuous record. Watch the exemption DEP singles out: an engine may run a lift gate during active loading or a processing device, and for a refrigerated truck you must show that the engine that moves the vehicle was on and was not running the refrigeration unit.

For a crash
The risk after a crash is not that the footage is rejected but that it no longer exists. The manuals for VIOFO, Garmin, Nextbase, Vantrue, BlackVue and Tesla describe the same loop: when the card fills, the camera writes over older unprotected video. Lock the clip, stop the camera from recording, and copy the original file twice without trimming or converting it; note the file name and how far the camera clock is off. If your own camera missed it, other people's may not have. The footage board puts a request in front of registered dashcam owners in your state, and if you drive with a camera running you can register it to hear when footage near your routes is wanted. Insurance: what we could confirm
We looked for a major US insurer that publishes a premium discount for having a dashcam and did not find one on an insurer's own site as of October 2026; the discount claims that circulate trace back to camera sellers and affiliate blogs. Usage-based programs that score your driving through an app or plug-in device are a different product. Ask your carrier directly, and ask how it wants footage submitted with a claim.
The money a camera can save is in claims, not premiums: a clear clip of the other driver's fault, the plate of a driver who left, or the moment of a staged stop. Footage also shows your own driving, so review a clip before you hand it over.
Frequently asked questions
Can I use dashcam video for an NYC idling complaint?
Yes, if the clip meets DEP’s evidence list: continuous time and date stamped video for the full idling period, an audible engine or visible exhaust, the plate and company name, and the sidewalk side, front and back of the vehicle where practicable. A single windshield camera cannot frame all of that, so plan to film the sides and markings by hand.
Does a dashcam lower car insurance in the US?
We could not confirm that any major US insurer publishes a dashcam discount; the claims we found came from camera sellers and affiliate blogs, not insurers. Ask your own carrier. The verifiable value is in claims: a clip of the other driver’s fault, the plate of a driver who left, or the moment of a staged stop.
Do locked dashcam clips stay safe forever?
No. Locking protects a clip from normal loop recording, not from everything: Nextbase says its Series 2 cameras reserve about 30 percent of the card for protected files and then overwrite the oldest of them, and formatting erases locked files too. Copy the file off the card the same day.
